Purpose

To prevent sexual harassment in the workplace and to meet [YOUR BUSINESS NAME]'s positive duty to take reasonable and proportionate measures to eliminate sexual harassment, as required by Queensland law.

Scope

All workers, contractors, visitors, and customers at [YOUR BUSINESS NAME].

Definition

Sexual harassment is any unwanted or unwelcome sexual behaviour that a reasonable person would find offensive, humiliating, or intimidating. It includes:
  • Unwanted sexual advances or requests for sexual favours
  • Unwanted touching, kissing, or physical contact of a sexual nature
  • Staring or leering
  • Sexually explicit comments, jokes, or gestures
  • Displaying or sending sexually explicit material
  • Intrusive questions about a person's private life or body
  • Sexual harassment is unlawful under the Anti-Discrimination Act 1991 (Qld) and the Sex Discrimination Act 1984 (Cth).

    Prevention Measures

    [YOUR BUSINESS NAME] will:

    1. Provide training to all workers on sexual harassment prevention (at induction and annually).
    2. Display this policy in the workplace and on the staff portal.
    3. Ensure all managers and supervisors are trained to respond appropriately to complaints.
    4. Conduct regular risk assessments to identify and address factors that may contribute to sexual harassment.
    5. Foster a workplace culture of respect and inclusion.

    Reporting

    If you experience or witness sexual harassment:

    Step 1: You are not required to confront the harasser directly — this is optional. Step 2: Report to your supervisor, manager, or the PCBU. If the complaint involves management, contact the PCBU directly. Step 3: All complaints will be investigated promptly, fairly, and confidentially. External options:

  • Consequences

    Sexual harassment is serious misconduct and may result in disciplinary action up to and including termination of employment, and may also constitute a criminal offence.
